Clinical Biostats, LLC

These Terms of Use ("Terms") govern your access to and use of websites, mobile applications, and related services operated by Clinical Biostats, LLC ("Clinical Biostats," "we," "us," or "our"), including the CalcPass mobile application (the "App").

By downloading, accessing, or using the App, you agree to these Terms. If you do not agree to these Terms, do not download, access, or use the App.

1. The Service

CalcPass is an educational application designed to help students prepare for the AP Calculus AB and AP Calculus BC examinations.

The App currently provides ten chapters of calculus instruction, chapter tutorials, practice questions, chapter quizzes, a full-length practice examination, study progress tracking, and a personalized study schedule based on the user's selected examination date.

The App also provides a predicted AP score based on performance on the practice examination. Any predicted score is a statistical estimate intended to provide educational feedback and is not a guarantee of an actual examination score.

Clinical Biostats may modify, update, improve, replace, or discontinue features of the App from time to time.

Free Access

CalcPass provides certain content and functionality at no cost. The free version currently includes the complete Chapter 1 tutorial and five sample practice questions.

The free portion of the App does not require an account or subscription and does not expire solely because of the passage of time.

CalcPass+

Additional content and functionality are available through a paid CalcPass+ subscription. Depending on the applicable subscription and current version of the App, CalcPass+ provides access to all ten chapters, the complete 1,100-question practice bank, chapter quizzes, the full practice examination, and other premium study functionality.

2. Subscriptions

CalcPass+ is offered through Apple's App Store as an auto-renewable subscription. The subscription plans currently offered are:

• 3 months: $49.99
• 6 months: $89.99
• 1 year: $149.99

Prices may vary by country or region and may be subject to applicable taxes or other charges determined by Apple.

Automatic Renewal

CalcPass+ subscriptions automatically renew for another subscription period of the same duration unless you cancel the subscription in accordance with Apple's subscription procedures.

Your Apple ID account will be charged for renewal within 24 hours before the end of the current subscription period, subject to Apple's applicable policies.

Managing and Canceling Your Subscription

Subscriptions are managed through your Apple ID account and Apple's subscription management system.

You may view, manage, or cancel your subscription through your device's subscription settings, including:

iPhone or iPad: Settings → [Your Name] → Subscriptions

Canceling a subscription prevents future automatic renewal. Cancellation does not normally terminate your paid access immediately. You generally retain access to CalcPass+ features through the end of the subscription period that you have already paid for.

Clinical Biostats does not directly process subscription cancellations.

Purchasing and Restoring Subscriptions

Purchases are processed through Apple's App Store and Apple's in-app purchase system. CalcPass uses RevenueCat to help manage subscription entitlements and subscription status.

CalcPass includes a Restore Purchases function that allows eligible purchases to be restored in accordance with Apple's applicable policies.

After a purchase is completed, there may be a brief delay while the purchase is verified and the subscription entitlement is synchronized with the App's systems. Premium access becomes available after the applicable verification process is completed.

Changing Subscription Plans

The available CalcPass+ plans are part of the same Apple subscription group. If you are already subscribed and select a different CalcPass+ plan, Apple's subscription system determines how the change is handled under Apple's applicable upgrade, downgrade, billing, and effective-date rules.

Clinical Biostats does not independently determine the billing treatment or effective date of a subscription plan change.

Refunds

Purchases made through Apple's App Store are subject to Apple's refund policies. Clinical Biostats does not directly process refunds for App Store purchases.

If you wish to request a refund, you should use Apple's applicable refund process.

Price Changes

Clinical Biostats may change subscription prices from time to time. Any applicable notice, consent, or cancellation rights associated with a subscription price change will be handled in accordance with Apple's policies and applicable law.

3. Anonymous Application Access

CalcPass does not require users to create a traditional account using a username, password, email address, or telephone number.

The App uses anonymous authentication to associate application data with an anonymous identifier. This allows CalcPass to maintain information such as study progress, examination date, chapter confidence, answered-question history, onboarding status, and subscription entitlement information.

This anonymous application identifier is not intended to identify you by name. Additional information about the handling of application data is provided in the Clinical Biostats Privacy Policy.

4. Personalized Study Schedule

CalcPass allows users to provide an examination date through an in-app date picker. The App uses that date to provide a personalized pacing schedule intended to help users organize their study activities.

The schedule is an educational planning tool. Clinical Biostats does not guarantee that following the schedule will result in any particular academic or examination outcome.

5. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms.

You may not:

• Attempt to circumvent subscription, authentication, security, or access controls.
• Use automated tools, scripts, bots, crawlers, or similar mechanisms to scrape, extract, reproduce, or bulk-download content from the App.
• Attempt to obtain unauthorized access to the App's servers, databases, APIs, backend services, or other systems.
• Attempt to manipulate subscription entitlements or other access controls.
• Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App, except to the extent such activity cannot legally be prohibited.
• Copy, reproduce, redistribute, republish, sell, license, or commercially exploit the App's content without written authorization.
• Use the App in a manner that interferes with its operation, security, or availability.
• Use the App for any unlawful purpose.

6. Educational Content

CalcPass contains educational materials intended to assist students with calculus study and examination preparation.

The App currently contains approximately 1,100 practice questions, tutorials, worked examples, explanations, quizzes, and examination materials.

Although Clinical Biostats makes reasonable efforts to provide accurate and useful educational content, we do not guarantee that every question, solution, calculation, explanation, recommendation, or other item of content will always be completely free from errors or omissions.

Educational content should be used as a study aid and not as a substitute for instruction from a teacher, professor, school, textbook, or other qualified educational resource.

7. AP and College Board Disclaimer

CalcPass is an independent educational product and is not affiliated with, endorsed by, sponsored by, or otherwise associated with the College Board.

The terms "AP," "AP Calculus," "AP Calculus AB," and "AP Calculus BC" are used solely to identify the educational subject matter and examinations for which the App is intended to provide preparation.

College Board is not responsible for the content, functionality, accuracy, or operation of CalcPass.

8. Predicted Scores and Academic Outcomes

CalcPass may provide an estimated or predicted AP score based on performance on the App's practice examination.

Such predictions are statistical estimates intended to provide educational feedback. They are not official AP scores and are not provided by the College Board.

Clinical Biostats does not guarantee any particular AP examination score, course grade, academic result, college admission result, or other educational outcome from use of CalcPass.

Actual examination performance depends on many factors outside our control, including prior preparation, study habits, classroom instruction, examination conditions, and performance on the actual examination.

9. Intellectual Property

The App and its content, including but not limited to software, source code, interfaces, designs, graphics, written materials, tutorials, practice questions, worked solutions, answer explanations, databases, and other original materials, are owned by or licensed to Clinical Biostats, LLC and are protected by applicable copyright, trademark, and other intellectual property laws.

Your purchase of a CalcPass+ subscription does not transfer ownership of any intellectual property to you.

10. Limited License

Subject to these Terms and your continued compliance with them, Clinical Biostats grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the App and its content for your personal, non-commercial educational purposes.

You may not redistribute, republish, sell, license, publicly distribute, or commercially exploit substantial portions of the App's content.

11. App Availability and Changes

Clinical Biostats may modify, update, suspend, or discontinue the App or any portion of its functionality at any time.

Features, questions, tutorials, study tools, subscription offerings, pricing, interfaces, and other content may be added, removed, or modified.

We do not guarantee that the App or any particular feature will always be available, uninterrupted, secure, error-free, or compatible with every device or version of Apple's operating systems.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP AND ALL CONTENT AND SERVICES PROVIDED THROUGH THE APP ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLINICAL BIOSTATS DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF INACCURACIES, OR THAT ANY DEFECTS WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, CLINICAL BIOSTATS, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

THIS INCLUDES, WITHOUT LIMITATION, CLAIMS RELATING TO LOST DATA, INTERRUPTION OF SERVICE, ACADEMIC PERFORMANCE, EXAMINATION RESULTS, COURSE GRADES, OR OTHER EDUCATIONAL OUTCOMES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLINICAL BIOSTATS' TOTAL LIABILITY ARISING OUT OF OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO CLINICAL BIOSTATS FOR THE APPLICABLE APP OR SERVICES DURING THE TWELVE MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

Nothing in these Terms is intended to exclude or limit liability that cannot legally be excluded or limited under applicable law.

14. Termination and Suspension

You may stop using the App at any time.

Clinical Biostats may suspend or terminate access to the App or particular features if we reasonably believe that you have violated these Terms, attempted to circumvent subscription or security controls, attempted to extract or redistribute protected content, or otherwise used the App in a manner that threatens the security or operation of the service.

Termination or suspension does not affect provisions that by their nature should survive termination, including provisions concerning intellectual property, disclaimers, limitations of liability, and governing law.

15. Privacy

Your use of the App is also subject to the Clinical Biostats Privacy Policy.

The Privacy Policy explains how information is collected, used, stored, and processed in connection with CalcPass and other applicable Clinical Biostats services.

16. Third-Party Services

The App relies on third-party platforms and services to provide certain functionality, including Apple, Google Firebase, and RevenueCat.

Your use of third-party services may also be subject to the terms, conditions, and privacy policies of those third parties.

Clinical Biostats is not responsible for the independent policies, practices, availability, or operation of third-party services.

17. Apple's Role

These Terms are between you and Clinical Biostats, LLC and not Apple, Inc.

Apple has no obligation to furnish maintenance and support services with respect to the App.

To the maximum extent permitted by applicable law, Apple has no warranty obligation with respect to the App, and any claims, losses, liabilities, damages, costs, or expenses attributable to any failure of the App to conform to an applicable warranty will be governed by the relationship between you and Clinical Biostats and applicable law.

Apple is not responsible for addressing claims relating to the App, including product liability claims, claims that the App fails to conform to applicable legal or regulatory requirements, and claims arising under consumer protection or similar legislation.

Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you as a third-party beneficiary.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent that applicable law requires otherwise.

If any provision of these Terms is determined to be unenforceable, that provision will be modified only to the extent necessary to make it enforceable, and the remaining provisions will remain in effect to the extent permitted by law.

19. Changes to These Terms

Clinical Biostats may update these Terms from time to time to reflect changes to our applications, services, subscription offerings, business practices, or applicable legal requirements.

When we make changes, we will update the "Last updated" date at the top of these Terms. Where required by applicable law, we will provide additional notice of material changes.

Your continued use of the App after revised Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
